***NIPOMO BANK ROBBERY***



















On Tuesday, July 17, 2007 at 2:39 p.m., a white male adult, 45-50 years of age robbed the Los Padres Bank, 542 Tefft St. in Nipomo. The subject was further described as wearing a dark colored baseball cap with the word "Imagine" on it. He also had a short pony tail, square framed prescription glasses, a grey polo shirt and light colored walking shorts. The subject passed a teller a note demanding money then left the bank with an undisclosed sum. The suspect then walked eastbound into the Von's Market where he loitered inside the store restroom for approximately 5 minutes. The suspect was last seen leaving the Von's Market and walking into the public parking lot.

Prior to the robbery, a subject matching the description was seen walking away from a newer model dark colored mini type van. The vehicle was described as being in good, clean condition. No further description.

Welch was released from prison in July of this year (after doing time for failing to comply with his PC290 registration requirements) and was residing in a halfway house outside of Santa Maria. Welch has a lengthy criminal history. His longest prison sentence was 16 years for kidnapping and raping a young girl in northern California. He currently has a no bail, parole violation, warrant and has been a PAL (person at large) since 10-24-06.

Welch may return to SLO county, possibly the Paso Robles/San Miguel area, due to family ties there.

The Sheriff’s Department is asking for the public’s help in identifying the subject in this video footage. The subject robbed the Santa Margarita Plaza Liquor Store at 22350 G Street in Santa Margarita on 12-12-05 at 1040 hours. After showing the clerk a black handgun and demanding money he fled in a smaller silver sedan northbound on El Camino Real. He is described as a male approximately 40-50 years old, approximately 5 feet 11 inches tall and weighing 175-200 pounds with short blond hair, possibly balding. Anyone with information about this subject is asked to call Sheriff’s Detectives at 781-4500, the Sheriff’s Watch Commander at 781-4553, or Crime Stoppers at 549-STOP.

On 1-28-05 at about 0100 hours, an unidentified white male entered a residence on Estrella Rd. in rural San Miguel. He abducted and attempted to sexually assault the adult female resident. The victim resisted and the suspect fled on foot in an unknown direction.

On Tuesday, December 7, 2004, shortly after 9:30 a.m., the California Highway Patrol Dispatch Center received a series of bomb threats by telephone. The bomb threats were directed at the Nipomo High School. The Highway Patrol notified the San Luis Obispo County Sheriff’s Department and the school was evacuated.

Sheriff’s Deputies, officers from the California Highway Patrol, members of the San Luis Obispo County Bomb Task Force, and bomb detection canines from State Parks and Recreation at Hearst Castle, conducted a coordinated search of the school and found no explosive devices.

Sheriff’s Detectives began an investigation into the origin of the telephone calls received by the Highway Patrol Dispatch Center. As a result of the investigation a suspect was identified, and on Wednesday, December 8, 2004, Detectives arrested JESUS ALEJANDRO ZAVALA, 18 years old, of Nipomo, for making a false report of a bomb. The investigation determined that the bomb threat was a hoax. Zavala was arrested at the County Jail, where he was in custody for unrelated charges. The investigation into the incident is continuing.

***ARMED ROBBERY***
On Monday, December 6th, at 3:51 p.m., the San Luis Obispo County Sheriff's Department received a 911 call from a female clerk at Tortilleria Sinaloa in San Miguel reporting an armed robbery. The clerk reported that three male subjects armed with handguns had entered the store demanding cash and merchandise. After receiving the property, the suspects drove away in a maroon 1998 Mitsubishi Mirage. Neither the clerk nor any of the customers were injured.

A Paso Robles Police Department officer saw the reported suspect vehicle near the intersection of Hwy 101 and Hwy 46 east, but lost sight of the vehicle in traffic. Shortly afterwards, a San Luis Obispo County Probation officer reported seeing the vehicle going east bound on Hwy 46 near Airport Road. A California Highway Patrol airplane assisted San Luis Obispo County Sheriff’s deputies and officers from the California Highway Patrol in following the suspect vehicle into Kern County. The suspects initiated a high speed pursuit when officers attempted a traffic stop on Highway 5 south of Highway 46. The pursuit continued with speeds in excess of 110 miles per hour south on Highway 5 to Highway 58 and then north on Highway 33. The vehicle was eventually stopped at 5:37 pm by the California Highway Patrol.

Four suspects, identified as Francisco Ibarra Ibarra, 30, of North Carolina, Roberto Espino Alvarez, 32, of North Carolina, Margarito Sanchez Espino, 24 of Los Angeles, and Ricardo Ambriz Ramirez, 23 of North Carolina were taken into custody without incident and booked for armed robbery and use of a firearm during a felony. Bail was set at $60,000 each.

On Friday, October 29, 2004, the San Luis Obispo County Sheriff’s Department received a 911 call regarding an adult male trying to abduct a young girl in Nipomo.

Early Friday morning, a 16 year old female juvenile was attacked while walking alone to the school bus stop located on Moss Lane cross of Hutton Road, in Nipomo. The suspect, described as an Hispanic male, 25 to 35 years of age, approximately 5-8, medium build, short black hair with no facial hair, wearing a large blue hooded jacket, came up behind the victim, grabbed and wrestled her to the ground. When the victim began screaming, the suspect let go and ran away.

The San Luis Obispo County Sheriff’s Department is asking for assistance from the community in identifying the man responsible for the attempt abduction of a young Nipomo girl. A composite drawing of the man was developed. Mary Catherine Waterbury Murder (1985)

June 2, 2004

On October 21, 1985, Mary C. Waterbury was found murdered in Montana de Oro State Park. She had previously been reported missing by her roommate when she failed to return home. Mary had been found after an extensive air and land search conducted by Sheriff’s Department personnel, Sheriff’s Search and Rescue members and State Park Rangers.

The body of Mary Waterbury was found in heavy brush approximately one-half mile south of the entrance to Montana de Oro State Park. Her yellow 1971 Volkswagen sedan was also found parked several hundred yards east from where her body was located.

Mary Waterbury was found partially clothed in the same jeans and T-shirt she was wearing when she was last seen. An autopsy conducted by the coroner’s unit determined that Waterbury’s death was due to asphyxiation. The forensics examine also revealed that Waterbury was sexually assaulted. During the autopsy examination, blood, hair, saliva and other genetic evidence was collected and kept for the purpose of obtaining a possible blood type match on a suspect.

Since the time of this murder, DNA technology has been established and extensively developed. Sheriff’s detectives have submitted genetic evidence twice since 1990. The first testing in 1990 showed that there was identifiable DNA in the submitted sample that was not that of Mary Waterbury. Another sample was submitted in 2003 to the California Department of Justice Crime Lab for analysis. A DNA “fingerprint” was established for comparison against individuals who have been required to submit DNA samples due to criminal convictions.


On May 14, 2004, the Sheriff’s Department was informed that a DNA match had been made with the DNA of Peter Derks, date of birth August 26, 1946. It was determined that was a resident of Arroyo Grande and was required to register as a sex offender. Derks had been arrested as the result of an attempted assault with a deadly weapon in 1987 in Montana de Oro State Park. He was one of several dozen individuals who had been looked at in the Waterbury case over the years, but the lack of useable evidence at that time prevented a case from being made until this recent DNA match. As a point of clarification, his DNA sample was not collected until his release in 1991.

Because Peter Derks had now been identified as a murder suspect, detectives began a thorough review of the evidence collected over 18 years ago. The District Attorney’s Office was contacted and investigators from both offices worked together establishing a case that could be filed with the court. Information was also put together that would allow for obtaining a search warrant for Derks' residence in Arroyo Grande.

Although this murder did occur over 18 years ago, having an identified murder suspect not in custody was of significant concern. The Sheriff’s Department began a surveillance of Derks and it continued for over two weeks. The California Attorney General’s Office was contacted and assistance was requested and received from the California Bureau of Investigation’s Sexual Predator Apprehension Team. The assigned team is out of the Los Angeles Field Office and normally is tasked with watching high-risk sexual offenders who have been released from custody, but the circumstances in this case allowed them to assist this department until the arrest could be made.

Derks will be arraigned in Superior Court this week.

Andrea Hug Murder Investigation Update

The San Luis Obispo County Sheriff’s Department is continuing the investigation into the October 11, 1998, death of Andrea Hug. Hug was found at the base of a cliff within Montano De Oro State beach on the morning of October 12, 1998. Her death has been ruled a homicide.

An interview was conducted on December 8, 2003, in San Quintin Prison of a man housed on death row. Rex Allan Krebs was interviewed by Sheriff’s Detective Steve Crawford and Assistant Chief Investigator Larry Hobson from the District Attorney’s Office. Their interview delved into any connection between Hug and Krebs. Krebs had been convicted of the kidnap and murder of Andrea Crawford and Rachel Newhouse.

While the investigation is continuing, there is no immediate link between Hug and Krebs. Investigators have not focused on Krebs at the exclusion of other potential suspects. Based on leads from the community, investigators are looking into at least one additional individual that frequents the San Francisco Bay area.

Witness: Unknown Name Male 5'-08" tall, 170 lbs. Witness described as having black hair, gaunt, sunken cheeks, large pointed nose, dark sunglasses and dark clothing.

Vehicle: Older model van, possible a Chevy. Van described as white having a green stripe running horizontally around the van.

Facts: On Oct. 11, 1998, Andrea Hug was visiting Montana De Oro State Park, near Los Osos California. Hug was assaulted on a secluded hiking trail, and fell over a cliff. The witness was the last person seen talking to the victim and then several hours later seen trying to start the van.
